2. Scope & Definitions
These Terms & Conditions of Sale (the “Terms”) apply to all purchases made through www.onohome.com (the “Website”), by:
- Consumers: natural persons acting for purposes outside their trade, business or profession; and
- Professionals: any person acting for purposes relating to their trade, business or profession (e.g., architects, designers, companies).
Nothing in these Terms limits or excludes any rights that cannot be limited or excluded under applicable law (including mandatory consumer protection rules).
3. Language and Prevailing Version
These Terms are drafted in English. If a translation is provided for convenience, the English version shall apply for interpretation purposes, without prejudice to mandatory Consumer protection rules that may apply.
4. Products
4.1 Made-to-order and customised products
Onohome sells premium furniture and décor items that are made-to-order and, in most cases, customised based on the Client’s choices (including, without limitation, dimensions, fabrics, leathers, woods, metals, stones, glass, and finishes). Products are not supplied on a “try-before-you-buy” basis.
4.2 Product information and visuals
Product descriptions, specifications, dimensions and indicative lead times are provided on the Website and/or upon request. Images, photographs, renderings and visuals are provided for reference purposes only and may present variations inherent to handcrafted and natural materials, without affecting the essential characteristics of the Products.
4.3 Natural variations, tolerances, and ageing
The Client expressly acknowledges and accepts that premium materials and craftsmanship may result in minor variations, including:
- dimensional tolerances customary in high-end furniture manufacturing;
- colour and shade variations between production batches (fabrics, leathers, lacquers, finishes);
- natural variations in wood grain/knots, marble veining, stone structure, metal patina, and glass texture;
- changes due to lighting conditions, UV exposure, and natural ageing of materials.
- small differences in dimensions (+/- 2%) due to the artisanal quality of the products
Such variations are inherent to premium materials and manufacturing processes and, where they remain minor and do not affect the essential characteristics or functionality of the Product, do not constitute a defect or lack of conformity and cannot justify refusal of delivery, cancellation, or refund.
4.4 Digital renderings, 3D configurators and previews (informative only)
Digital renderings, 3D configurators, visual previews and simulations (including any 3D deliverables made available through Onohome’s configurator and/or provided to the Client) are provided for illustrative and informational purposes only and do not constitute contractual representations.
The Buyer acknowledges that on-screen visualisations may differ slightly from the final Product due to, in particular, device and screen settings (calibration, brightness, colour profiles), lighting and rendering set-ups used for digital previews, and normal manufacturing, material and craftsmanship conditions.
Such differences are expected to remain minor, shall not affect the essential characteristics or functionality of the Product, and shall not constitute a defect or lack of conformity.
4.5 Paid samples (swatches)
Upon request, Onohome may provide paid material samples (swatches). Where applicable, the sample cost may be deducted from a subsequent order under the conditions communicated at the time of purchase of the samples.
5. Prices, Taxes and Currency
5.1 Display currencies and payment currency
Prices may be displayed in multiple currencies for convenience. Unless otherwise stated at checkout, all payments are made in EUR. Any currency conversion displayed is indicative only.
5.2 European Union (VAT)
For deliveries within the European Union, prices are displayed including VAT where applicable. The applicable VAT is calculated and confirmed at checkout.
5.3 Deliveries outside the European Union (export)
For deliveries outside the European Union:
- Products may be sold exclusive of VAT (export sale), where applicable;
- shipping costs, customs duties, import taxes and any local VAT are generally not included in the initial order price unless expressly stated;
- these costs may be communicated after the order is placed and prior to shipment.
5.4 Incoterms (Outside EU) — DDP vs DAP
Depending on destination and feasibility, Onohome may offer shipment on a DDP (Delivered Duty Paid) basis or on a DAP basis (Delivered At Place, duties/taxes unpaid), as those terms are commonly understood and/or under Incoterms® 2020 where applicable.
The Client expressly acknowledges that, for deliveries outside the European Union, shipping costs, customs duties and local taxes may not be included in the initial order price and may form an essential condition of shipment. Shipment shall only occur after full payment of such costs (via a payment link where applicable).
The Client may be required to provide information or documents necessary for customs clearance. Any delay, storage, demurrage or additional costs resulting from missing or incorrect information provided by the Client shall be borne by the Client.
6. Orders
6.1 Contract formation
Each order submitted through the Website constitutes an offer to purchase. The sale contract is formed when Onohome confirms the order (including by email confirmation and/or order confirmation on the Website) and receives the required payment (full payment at checkout or bank transfer deposit, as described in Section 7).
6.2 Firm and final nature (made-to-order/custom)
Given the made-to-order and customised nature of the Products, orders are deemed firm and final upon placement, subject only to (i) the cancellation right in Section 8, (ii) mandatory Consumer rights (where applicable), and (iii) Onohome’s acceptance of a modification in writing.
For the avoidance of doubt, any choice of dimensions, configuration, fabric/leather, finishes, materials, colours or options is considered a personalisation/customisation for the purposes of these Terms.
6.3 Accuracy of information
The Client is responsible for providing accurate information (identity, contact details, delivery address, access constraints, etc.). Onohome shall not be liable for delays or costs resulting from inaccurate or incomplete information.
6.4 Orders for Professional / resale purposes
Onohome reserves the right to refuse or cancel any order that appears to be placed for unlawful purposes, fraud, or where the Client information is manifestly inaccurate.
7. Payment
7.1 Payment at checkout (default) and optional bank transfer split
Default rule: Orders placed on the Website are payable in full at checkout via Shopify (using the payment methods offered at checkout). Production and/or sourcing generally starts once the full payment has been received.
Optional bank transfer split (upon request and written confirmation by Onohome): If the Client requests payment by bank transfer, Onohome may, at its sole discretion, accept a split payment of 50% deposit to start production and 50% balance payable upon arrival of the Products at Onohome’s warehouse and prior to scheduling delivery. This option is not automatic and must be confirmed in writing by Onohome.
Failure to pay any amount due (including the balance under the split payment option) entitles Onohome to suspend delivery and apply storage fees in accordance with Section 10.
7.2 Payment methods
Payments are processed through Shopify and may include credit/debit cards, PayPal, bank transfer (where offered/accepted), and any other method offered at checkout, depending on availability.
7.3 International supplementary payment link
For deliveries outside the European Union, Onohome may issue a payment link for shipping and, where applicable, customs duties/import taxes/local VAT. Shipment shall only occur once such payment is completed.
7.4 Retention of title
The Products remain the property of Onohome until full payment of all sums due (including shipping, duties/taxes where applicable, and storage fees if any).
8. Cancellation
The Client may request cancellation of any order within 24 hours of placement by written notice (email is sufficient) to claims@onohome.com. After this period, production and/or sourcing processes may have started and cancellation may no longer be possible, subject to mandatory Consumer rights (if any).
9. Delivery
9.1 Delivery methods (default)
- Mainland France: room-of-choice delivery by default (where feasible).
- European Union: standard curbside / street-level delivery by default.
- Outside EU: standard curbside / street-level delivery by default.
9.2 Optional premium services
White-glove delivery, installation, and special access solutions may be offered upon quotation. If a nacelle/lift service is required, the cost is EUR 250 per half-day (unless otherwise stated in the quotation).
9.3 Access conditions (Client responsibility)
The Client is solely responsible for ensuring adequate access to the delivery location (doors, corridors, stairs, elevators, permits, parking, building rules, time restrictions, etc.). The Client must ensure that the Products can be safely delivered to the intended room/location. Any additional cost, handling, special equipment, failed delivery attempt, storage, re-delivery or return due to inadequate access or missing information will be charged to the Client.
9.4 Indicative lead times and production closures
Lead times displayed on product pages or communicated by Onohome are indicative estimates. They typically refer to production time and do not necessarily include transit, customs clearance, or final delivery scheduling. Lead times may vary depending on materials availability and workshop capacity.
The Client acknowledges that manufacturers, workshops and craftsmen may be closed or operate at reduced capacity during certain periods (including, without limitation, summer closures in August and end-of-year holidays). In such periods, production lead times may be suspended or extended accordingly.
Delays do not entitle the Client to damages or cancellation, except where mandatory Consumer protection laws provide otherwise.
9.5 Appointment
Deliveries are generally scheduled by appointment, typically within a half-day time window, depending on carrier constraints.
9.6 Transfer of risk
For Consumers, the risk of loss or damage to the Products transfers when the Consumer (or a third party designated by the Consumer) takes physical possession of the Products, unless the Consumer has chosen a carrier not proposed by Onohome (in which case risk may transfer upon handover to that carrier, to the extent permitted by law).
For Professionals, unless otherwise agreed in writing, risk transfers upon handover of the Products to the carrier or forwarder.
10. Storage Fees
If delivery is delayed due to the Client’s unavailability, failure to accept delivery, failure to pay amounts due, or request to postpone delivery, Onohome may store the Products.
A free storage period of 1 (one) week applies from the date Onohome notifies the Client that the Products are ready for delivery scheduling (or, where applicable, from the date the balance becomes due under the split payment option). After this free period, storage fees are EUR 50 per week (or pro-rated equivalent), and continue until delivery can be completed. Storage fees reflect handling, warehousing, and administrative costs.
11. Receipt and Transport Claims
11.1 Inspection upon delivery
Upon delivery, the Client must inspect packaging and Products. If any anomaly is noticed, the Client should:
- add detailed written reservations on the carrier’s delivery slip (not generic wording);
- take clear photos (packaging and damage);
- notify Onohome at claims@onohome.com within 48 hours of delivery.
11.2 Outcome
Depending on the situation, Onohome may offer repair, replacement, or partial compensation.
This transport-claim procedure is intended to facilitate carrier claims and does not affect or limit the Client’s statutory rights, including legal warranties (see Section 13).
12. Right of Withdrawal (Consumers Only)
12.1 Standard (non-customised) Products
Where applicable under mandatory law, Consumers may withdraw from the contract within 14 days of receiving the Products, provided the Products are not customised and are returned in resalable condition.
Return shipping is at the Consumer’s expense and must be insured and tracked. The Consumer is responsible for the Product until it is received by Onohome.
12.2 Exclusions (customised / bespoke)
The right of withdrawal does not apply to Products made to the Consumer’s specifications or clearly personalised, including (without limitation) Products where the Consumer has chosen size/dimensions, configuration, fabrics, leathers, metals, woods, stones, glass, finishes, or any configuration choice.
13. Legal Warranties (Statutory Rights)
Products benefit from the statutory legal warranties applicable under French and EU law. Nothing in these Terms limits or excludes the statutory legal warranties applicable to Consumers.
Spare parts availability is subject to the manufacturer’s availability.
14. Liability
14.1 Professionals
For Professionals, Onohome’s total aggregate liability arising out of or in connection with a sale shall be limited to the amount paid for the Products concerned. To the maximum extent permitted by law, Onohome shall not be liable for indirect or consequential damages (including loss of profit, loss of business, loss of opportunity).
14.2 Consumers
This limitation does not apply to Consumers where prohibited by applicable law, and does not affect liability that cannot be limited or excluded under mandatory rules.
14.3 Force majeure
Onohome shall not be liable for any failure or delay in performance due to events beyond its reasonable control (including, without limitation, strikes, supply chain disruption, carrier disruption, governmental restrictions, customs delays, or network outages), to the extent permitted by law.
15. Personal Data
Personal data is processed in accordance with Onohome’s Privacy Policy and applicable GDPR regulations. Please refer to the Privacy Policy and Cookie Policy available on the Website for details.
16. Dispute Resolution and Consumer Mediation
Before escalating any dispute, the Client is invited to contact Onohome’s Customer Service at claims@onohome.com.
Consumers (France): In accordance with the provisions of the French Consumer Code concerning the amicable settlement of disputes, Onohome adheres to the following Mediation Service: Centre de Médiation de la Consommation de Conciliateurs de Justice, 14 rue Saint Jean, 75017 Paris, France. The Consumer may refer the matter to the mediation service after having first contacted Onohome in writing and if the dispute has not been resolved.
17. Governing Law and Jurisdiction
17.1 Governing law
These Terms shall be governed by French law, without prejudice to mandatory Consumer protection rules that may apply.
17.2 Jurisdiction — Professionals
For Professionals, any dispute arising out of or in connection with these Terms shall fall under the exclusive jurisdiction of the courts of Paris.
17.3 Jurisdiction — Consumers
For Consumers, jurisdiction shall be determined in accordance with applicable Consumer protection laws. Consumers may also bring claims before the courts of their place of residence, where applicable.
